No person shall, on the basis of race, color, religion, sex (including, pregnancy, gender identity and sexual orientation), national origin, age (40 or older), disability, or genetic information be excluded from participation in, be denied the benefits of, or be subject to discrimination in employment, recruitment, consideration, or selection therefore, whether full-time or part-time under any education program or activity operated by a recipient which receives or benefits from federal financial assistance.
